TERMS AND CONDITIONS
Salon Services User Agreement
1. General provisions
1.1. "SALON PRO" LLC (hereinafter referred to as "Salon") offers the Internet user (hereinafter referred to as "User") to use its services under the conditions set forth in this User Agreement (hereinafter referred to as "Agreement", "OS"). The Agreement comes into force from the moment the User agrees to its terms in accordance with clause 1.4 of the Agreement.
1.2. All currently operating services of the Salon, the terms of use of which are included in this Agreement (hereinafter "Salon Services"), as well as any development and (or) addition of new ones, are the subject of this Agreement.
1.3. The use of Salon services is governed by this Agreement, the terms of use of separate Salon services. The Salon may modify the Agreement. In the event of significant changes to the Terms, the Salon undertakes to notify its users of them. The new version of the Agreement becomes effective from the moment it is posted on the Internet at the address specified in this clause, unless otherwise provided by the new version of the Agreement. The current version of the Agreement is always located at https://appointmateco.tilda.ws/termsandconditions.
1.4. By starting to use any service or its individual functions or going through the registration procedure, the User fully accepts the terms of the Agreement without any reservations or exceptions. If the User does not agree with any of the provisions of the Agreement, the User is not entitled to use the Services of the Salon. If the Salon has made changes to the Agreement in accordance with clause 1.3 of the Agreement, with which the User does not agree, he is obliged to stop using the Services of the Salon.
2. General Terms of Use and Maintenance
2.1. The Salon has the right to set restrictions on using the Salon services for all Users or certain categories of Users (depending on the location of the User, the language in which the service is provided, etc.), including the availability or absence of certain functions of the service. The Salon may prohibit automatic access to its services, as well as stop accepting any automatically generated information (for example, email spam).
In order to protect the User's equipment and its own equipment, the Salon has the right to limit the reception of any messages and their sending to the User if these messages contain malicious software or code or if the Salon's automatic filtering and anti-virus protection tools have detected such malicious software or code in the said messages. The User is aware and agrees that the Salon has the right to analyze and study the malicious programs and codes contained in these messages in order to improve the quality of the Salon's automatic filtering and anti-virus protection.
2.2. The Salon has the right to send informational messages to the User. The Salon is also entitled to send advertising messages to the User on the condition that consent has been obtained in accordance with the requirements of the law, or on the condition that the User has not opted out of receiving advertising messages on the relevant service (during registration or later using the relevant function).
The User agrees that the Salon will notify other users of the given service about the User's public actions, his posting of new publications, his actions related to the content of other users, as well as other actions performed by him within the scope of the service.
2.3. In order to improve the quality of services, the Salon and/or the persons engaged by it to conduct a survey have the right to collect the opinions and feedback of the Users on various issues by sending an informational message when the User visits the service again, or by contacting the User through the means of communication specified in the User's account (phone calls or e-mail). by letters). Based on the collected opinions and feedback, statistics can be generated that can be used in the Services. The Salon may also publish the opinions provided by the User during the survey on the services of the Salon or Salon branches, with or without specifying the User's name (username). When providing reviews, the User is obliged to be guided by the requirements of this Agreement, including the requirements set forth in Clause 4 of this Agreement.
3. User Content
3.1. The User is solely responsible for the compliance of the content he posted with the requirements of the current legislation, he is also responsible to third parties in cases where this or that content posted by the User violates the rights and legal interests of third parties, the personal non-property rights of the authors, third parties other intellectual rights and/or infringes on their intangible interests.
3.2. The User acknowledges and agrees that the Salon is not obligated to view any content posted and/or distributed by the User through the Salon services, and that the Salon has the right (but not the obligation) at its discretion not to allow the User to post content and/or to share or delete any content, which is available through Salon Services. The User acknowledges and agrees that it must independently evaluate all risks associated with the use of the Content, including the reliability, completeness or usefulness of the Content.
3.3. The User acknowledges and agrees that the technology of the Salon services may require copying (reproduction) of the User's content by the Salon, as well as processing by the Salon to meet the technical requirements of this or that service.
4. Terms of use of salon services
4.1. The user is solely responsible for his actions related to the use of the Salon services to third parties, if these actions lead to the violation of the rights and legal interests of third parties, as well as for following the law when using the Salon services.
4.2. When using the services of the salon, the User does not have the right to:
4.2.1. download, send, transmit or in any other way post and/or distribute content that is illegal, harmful, defamatory, offensive to morals, shows (or promotes) violence and cruelty, violates intellectual property rights, promotes hatred of people and (or) discrimination on the basis of racial, ethnic, sexual, religious, social characteristics, contains insults to any persons or organizations, contains (or promotes) elements of pornography, child eroticism, advertises (or promotes) sexual services ( including under the guise of other services), explains the procedure for the preparation, application or other use of narcotics or their equivalents, explosives or other weapons,
4.2.2. violate the rights of third parties, including minors, and/or harm them in any way,
4.2.3. to present oneself as another person or as a representative of an organization and (or) community, including as a Salon employee, forum moderator, website owner without having sufficient rights for this, as well as using any other form and method of illegal representation of other persons on the network, such as also mislead users or the Salon as to the properties and characteristics of any item;
4.2.4. download, send, transmit or in any other way post and/or distribute content in the absence of rights to such actions by law or any contractual relationship;
4.2.5. without specific permission to download, send, transmit or in any other way post and/or distribute advertising information, spam (including search engine), other people's e-mail addresses, pyramid schemes, multi-level (network) marketing (MLM), earning income from the Internet systems and e-mail businesses, "emails of happiness", as well as use the Salon Services to participate in these events or use the Salon Services solely to redirect users to pages on other domains;
4.2.6. download, send, transmit or otherwise install and/or distribute any materials containing viruses or other computer codes, files or programs designed to disrupt, destroy or limit the functions of computer or telecommunications equipment or programs, to gain unauthorized access, as also serial numbers of commercial software products and programs to create them, logins, passwords and other means to gain unauthorized access to paid resources on the Internet, as well as to post links to the above information;
4.2.7. collect and store personal data of other persons without permission,
4.2.8. disrupt the normal operation of Salon websites and services,
4.2.9. promote actions aimed at violating the restrictions and prohibitions established by the Agreement,
4.2.10. reproduce, duplicate and copy, sell and resell, as well as use for any commercial purposes any part of the Salon Services (including content that is available to the User through the Salon Services) or access to it, unless the User has such permission.
4.3. Termination and cancellation of the use of the Services:
4.3.1. The amount paid by the User for using the salon services is non-refundable. To cancel the service early, you must delete the user account in the application settings.
4.3.2. Failure to pay the next payment for using the salon services will mean the termination of the use of the Salon services.
4.3.3. As a result of the termination of the use of the Salon services, the Salon may apply a number of restrictions to the User's account, as a result of which the Salon is not liable for losses incurred by the User.
5. Exclusive Rights to Services Content
5.1. All materials available through the Salon Services, including design elements, text, graphics, illustrations, videos, computer programs, databases, music, sounds and other materials (hereinafter referred to as Salon Services Content), as well as any content located on the Salon Services, are considered Salon, Exclusive Rights of Users and Other Copyright Owners.
5.2. The use of the content, as well as any other elements of the Salon services, is possible only within the functions of the given service. No element of the content of the Salon Services, as well as any content located on the Salon Services, may be used in any other way without the prior permission of the copyright owner. "Use" means: reproduction, copying, processing, distribution on any basis, display in frame, etc. Exceptions are the cases that are directly provided for by the RA legislation or the conditions of use of the given service of the Salon.
The user's use of elements of the content of the Salon Services, as well as any content for personal non-commercial use, is permitted provided that all copyright signs, related rights, trademarks, other copyright notices, the name (or pseudonym) of the author or copyright owner are preserved. : Exceptions are the cases that are directly provided for by the RA legislation or the user agreement of the given Salon service.
6. Third Party Sites and Content
6.1. Salon Services may contain links to other websites on the Internet (third-party websites). The salon does not verify the compliance of these third parties and their content with certain requirements (authenticity, completeness, legality, etc.). The Salon is not responsible for any information, opinions, announcements, advertisements and other materials posted on third-party websites, which become available to the User from the Salon services, as well as for the consequences of accessing these websites or content and the User's use of them.
6.2. A link (in any form) to any website, product, service, commercial or non-commercial information on the website does not constitute an endorsement or recommendation of the products (services, activities) by the Salon, except as expressly stated in the Salon resources.
7. Advertising in Salon services
7.1. The salon is responsible for the advertisements placed in the services of the salon, in the cases defined by the legislation of the Republic of Armenia.
8. Absence of Warranties, Limitation of Liability
8.1. The user uses the services of the Salon at his own risk. Salon Services are provided "as is". The Salon is also not responsible for the suitability of the Salon services to the User's goals.
8.2. The Salon does not warrant that the Salon Services meet or will meet the User's requirements, the Salon Services will be provided continuously, quickly, reliably and without errors, the results obtained through the Salon Services will be accurate, reliable and may be used for any purpose or in any capacity (for example, to establish any fact and (or) to confirm), the quality of any product, service, information, etc. obtained as a result of using the Salon services will meet the User's expectations.
8.3. Any information and (or) materials (including downloadable software, letters, any instructions and guidelines, etc.) made available to the User from the Salon services, the User can use at his own risk and is responsible for the use of said information and (or) materials. for possible consequences, including possible damage to the User's or third parties' computer, loss of data or any other damage.
8.4. The Salon is not responsible for any kind of damage caused by the User's use of the Services or individual functions of the Salon.
9. Other Provisions
9.1. This Agreement is an agreement between the User and the Salon regarding the procedure for using the Salon services and replaces all previous agreements between the User and the Salon.
9.2. This Agreement is governed and interpreted in accordance with RA legislation. Issues not regulated by this Agreement are resolved in accordance with RA legislation. All possible disputes arising from the relations regulated by this Agreement are resolved in accordance with the RA legal norms in accordance with the procedure established by the current legislation of the RA.
9.3. If the Salon services provide for the possibility of formulating a paid subscription, then in order to form a subscription, the User makes a payment with the help of the payment system of partner organizations. The salon cannot be held responsible for payment problems. The amount of money to be paid and the features acquired in return are clearly and comprehensibly indicated on the relevant page of the application. 9.4. Nothing in the Agreement shall be construed as establishing an agency relationship, partnership relationship, joint activity, personal employment relationship or other relationship between the User and the Salon, which is not expressly provided for in the Agreement.
9.5. If for one reason or another, one or more provisions of this Agreement are declared invalid or lose legal force, this shall not affect the validity or enforceability of the remaining provisions of the Agreement.
9.6. Inaction of the Salon in case of violation of the provisions of the Agreements by the User or other users does not deprive the Salon of the right to take appropriate actions to protect its interests in the future and does not mean that the Salon waives its rights in case of similar violations in the future.
